What is Karnataka RERA and what is the RERA Act?

The Real Estate (Regulation and Development) Act, 2016 is a central law that requires real estate projects above set size limits to be registered before they are advertised or sold. It also sets duties for promoters and rights for buyers. Karnataka RERA is the Karnataka Real Estate Regulatory Authority, which enforces the Act in the state and runs the public portal where registered projects and complaints can be looked up. The portal says the Housing Department is the nodal department, that the Act came into force in May 2017 and that the Karnataka rules were notified in July 2017.

What does the RERA Act provide for home buyers?

As written, the Act requires a promoter to register a project and file its sanctioned plan, the carpet area of each apartment type and the time within which the project will be completed. It requires a declaration that a stated share of the money collected from buyers is kept in a separate bank account for construction and land cost, with withdrawals tied to certified progress. If possession is late, section 18 provides for a refund with interest or interest for each month of delay. Section 31 lets an aggrieved person complain. This describes the law, not how any one case turns out.

Is RERA applicable to plots and layouts in Karnataka?

The Act covers plots as well as apartments. It defines a real estate project to include the development of land into plots for sale, and it bars advertising or selling a plot in such a project without registration. Registration is not needed where the land is small or the apartment count is low, within the limits in section 3(2), and a state can lower them. The Karnataka housing department's rules FAQ also lists a registration fee category for plotted development, which shows plotted projects are registered. Whether a particular layout needs registration depends on its size and stage, so check the portal.

How do I check a project's status on the Karnataka RERA portal?

Open the project applications page on the Karnataka RERA portal. It groups applications by status, such as applied for registration, approved, rejected, withdrawn or revoked, under process, under query and applied for completion. You can search by project name, promoter or company name, application number, registration number, district and taluk, and you must enter at least one item. Use the registration number for the exact phase you are buying, because each phase is registered separately under the Act. A status label is a record entry, not a view on price or build quality.

What is the Karnataka RERA website and how do I contact the authority?

The official site is rera.karnataka.gov.in. Its menu covers project registration, project and agent status, complaints, orders and downloads such as the Act and a model allotment letter. The contact page gives a postal address in Bengaluru, telephone numbers and an email address, so check it for the current details before writing or calling. We could not find office hours on that page and do not state any. Use only the official domain, and be careful with look-alike sites or callers who ask you to pay to see a registration record.

How do I file a complaint with Karnataka RERA?

Go to the complaint login page on the Karnataka RERA portal. It asks you to log in or register as a new user, and it links a user manual for complaint registration. The housing department's rules FAQ says an aggrieved person may complain to the Authority on a prescribed form with a fee, and that compensation claims for matters such as late possession go to the adjudicating officer. Check the portal for the current form, fee and mode of payment. Keep your agreement, payment receipts and correspondence ready. Our guide walks through the steps.

What is e-khata in Bengaluru and how do I get one?

E-khata is a digitally signed khata record issued online. The state's e-Aasthi portal lists the steps: apply for a new khata through citizen login, check a draft e-khata if you know your ward, file objections on a final e-khata, track an application by its ePID number, then download the signed e-khata. It also lets you upload an encumbrance certificate so the property can be transacted, and verify an issued e-khata. The Greater Bengaluru Authority site links an e-khata help desk. We state no fee, because we found no fee page.

What is an encumbrance certificate and where do I apply for it?

On the Kaveri site the encumbrance certificate, or EC, is described as a record showing registered transactions pertaining to a property. Kaveri lists help topics on where to apply, the search basis, the details needed for a property number search, the fee calculation, downloading a digitally signed copy and what a nil result means. The e-Aasthi portal also lets owners upload an EC to a final e-khata. Because an EC reflects registered transactions only, ask your lawyer what it does and does not show for the period you choose.
